Law enforcement sometimes has to obtain private communication via lawful interceptions as part of their investigation of crimes. What can be (over)heard in these interceptions may end up as evidence in criminal prosecution. But very often their audio quality is less than ideal or so poor to the point that a transcript is required to accompany the recording to help the judges or juries hear better. When such recordings are monolingually in English, the law allows the investigator responsible for the case to produce the transcript, regardless of the fact that they have no training to undertake this task.
A growing body of literature has pointed to significant issues in the transcripts produced by law enforcement. Conversely, scholarship has only begun to emerge on issues relating to situations when these recordings contain languages other than English. This topic also has growing relevance in Aotearoa, where the multilingual nature of our communities intersects with law enforcement, migration, and justice systems. As our courts increasingly encounter non-English evidence, ensuring accuracy and professional standards in forensic transcription and translation is vital for upholding fair trial rights and equitable access to justice.
Dr Miranda Lai will share insights from
Australia about interpreters and translators involved in producing translations
of lawful interceptions and discuss inadequacies which need urgent attention.
